Contractor Terms and Conditions

Three things you need to understand before you spend any money with us:

  1. Enquiries may be sold to more than one contractor. You are not buying exclusive access. Other contractors may purchase the same enquiry and contact the same customer.
  2. We do not guarantee that any enquiry will turn into work. You are paying for the customer’s details, not for a job.
  3. You can see enough to identify the enquiry before you buy — this generally includes the customer’s name and the location of the project. What is shown varies depending on the type of enquiry. Checking this against your own records before purchasing is your responsibility.

If any of that does not suit your business, do not register.

1. Who we are and what we do

The Shed Guru is operated by B L Peck Construction Pty Ltd (“we”, “us”, “our”). We operate a platform that collects enquiries from people planning shed projects and makes those enquiries available to contractors (“you”, “your”) who register with us.

We are an introduction service. We are not a party to any contract between you and a customer. We do not supervise, direct, or take responsibility for the work you carry out.

2. Registering

To register you must:

  • Operate a genuine business with a current ABN
  • Hold any licence required by law for the work you perform
  • Hold appropriate insurance for the work you perform
  • Provide accurate information about your business

We check your ABN and, where applicable, your licence details at the time you register. We do this once, at registration. We do not monitor them afterwards.

Keeping your registrations current is your responsibility. If your licence, insurance, or ABN lapses, is suspended, or is cancelled, you must tell us immediately and stop purchasing enquiries. We are not responsible for verifying your ongoing compliance and we are not liable for any consequence of you operating without a current licence or insurance.

We may approve or decline any registration at our discretion.

3. Subscription

Access to the platform requires a subscription.

Subscription pricing varies depending on your trade, your business type, and the arrangement we have agreed with you. Your current price is shown in your account. We may offer free or discounted access during trial or promotional periods.

Subscriptions are billed in advance to the payment method you provide. You authorise us to charge that payment method for your subscription and for any enquiries you purchase.

You can cancel at any time. Cancellation takes effect at the end of your current billing period. We do not refund the unused portion of a period you have already paid for.

We may change subscription pricing by giving you at least 30 days notice. If you do not accept the new price, you may cancel before it takes effect.

4. Buying enquiries

Enquiries are purchased using credits.

The credit cost of an enquiry varies depending on the type of work, the size and scope of the project, and other factors. The cost of each enquiry is displayed before you purchase it.

Before you purchase, you can see preview details of the enquiry. This generally includes the customer’s name and the location of the project, though what is shown varies by enquiry type. Check this against your own records. If you have already quoted this customer, or the location is outside your service area, do not buy the enquiry. Once purchased, an enquiry is not refundable on those grounds.

Full contact details, including phone, email, and full address, are only released once you purchase the enquiry.

Once purchased, you receive the customer’s full contact details and project information.

Credits are not transferable and have no cash value. Unused credits are forfeited if your account is closed or terminated.

5. Enquiries are not exclusive

We may sell the same enquiry to more than one contractor. Customers often want multiple quotes, and we do not restrict how many contractors can purchase an enquiry.

This means another contractor may contact the same customer before you do, quote against you, or win the job. That is a normal part of how this platform works and is not a ground for a refund.

6. What we do not promise

We do not promise or guarantee:

  • That the customer will answer your call or reply to your message
  • That the customer will still want the work
  • That the customer has not already engaged someone else
  • That the customer’s budget matches your pricing
  • That you will win the job
  • Any particular volume of enquiries, or any enquiries at all
  • Any return on your subscription or credit spend

Purchasing enquiries carries commercial risk. That risk is yours.

7. Refunds

We want to be straightforward about this. There are two categories.

Where we will refund you

We will refund the credits you spent if the enquiry itself failed on our end. Specifically:

  • The enquiry was fabricated, or was not submitted by a real person
  • The contact details we supplied were wrong or non-functional, and you can demonstrate this
  • We sold you the same enquiry twice
  • The enquiry did not match the trade or work type it was listed under

Where the customer entered incorrect information — such as the wrong build address — and you can demonstrate this in writing, we will consider a refund on a case-by-case basis.

Where we will not refund you

  • The customer did not answer, did not return your call, or stopped responding
  • The customer chose another contractor
  • The customer’s budget or timeframe did not suit you
  • The customer was not ready to proceed
  • You did not contact the customer promptly
  • Another contractor also purchased the enquiry
  • You did not check the first name and suburb before purchasing

How to claim

Submit refund claims within 7 days of purchasing the enquiry, by emailing support@theshedguru.com.au. Include the enquiry reference and your evidence. Claims made after 7 days will not be considered.

We will assess your claim and respond in writing. Approved refunds are issued as credits to your account.

Your rights under Australian Consumer Law

Nothing in this section limits any rights you have under the Australian Consumer Law that cannot be excluded. If we have supplied you with something that fails to meet a consumer guarantee, you are entitled to a remedy regardless of what this section says.

8. How you must handle customer information

When you purchase an enquiry, you receive personal information about a real person. You must:

  • Use it only to contact that customer about that project
  • Not sell, share, pass on, or otherwise disclose it to anyone else
  • Not add the customer to any marketing list without their consent
  • Not contact the customer about anything other than their enquiry
  • Store it securely and delete it when you no longer need it
  • Comply with the Privacy Act 1988 (Cth) and the Spam Act 2003 (Cth)

Misuse of customer information is the most serious breach of these terms. If we find you have misused customer information, or the platform, we will terminate your account immediately, you forfeit any remaining credits and the balance of your subscription, and we may report the conduct to the relevant authority.

9. How you must conduct yourself

You must:

  • Contact customers professionally and promptly
  • Provide accurate information about your business, licences, and insurance
  • Carry out any work you are engaged for competently and in accordance with the law
  • Not misrepresent your relationship with The Shed Guru, or suggest we endorse, guarantee, or stand behind your work
  • Not use our name, logo, or branding without our written permission

10. Feedback and customer experience

We may collect feedback from customers about their experience with contractors introduced through the platform. We may use that feedback to decide whether to continue working with you.

We may suspend or terminate your account where we receive serious or repeated complaints.

11. Your relationship with customers is yours

Any agreement you enter into with a customer is between you and that customer. We are not a party to it.

You are solely responsible for:

  • Quoting and pricing your work
  • Any contract you enter into
  • The quality, safety, and legality of your work
  • Any warranty, defect, or dispute arising from your work
  • Any approvals, permits, or certifications required

We do not supervise your work and we accept no responsibility for it. If a customer has a dispute with you, they must take it up with you.

You indemnify us against any claim, loss, or cost we suffer as a result of your work, your conduct, or your breach of these terms.

12. Suspending or terminating your account

We may suspend or terminate your account, with or without notice, if:

  • You breach these terms
  • You misuse customer information
  • Your licence, insurance, or ABN lapses or is cancelled
  • Your payment fails or your subscription is not paid
  • We receive serious or repeated complaints about you
  • We reasonably believe your conduct puts customers or our business at risk

On termination you lose access to the platform and forfeit any unused credits.

You may close your account at any time by contacting us.

13. Our liability

To the maximum extent permitted by law, we are not liable for any loss, damage, cost, or claim arising from:

  • Enquiries that do not convert into work
  • The accuracy or completeness of information a customer provides
  • Another contractor purchasing the same enquiry
  • Any dispute between you and a customer
  • Any interruption, fault, or unavailability of the platform
  • Any decision you make based on information from the platform

This includes indirect and consequential loss, and loss of profit or opportunity.

Where we are liable and that liability cannot be excluded, our total liability to you is limited to the amount you have paid us in the 3 months before the claim arose.

Nothing in these terms excludes, restricts, or modifies any right or remedy under the Australian Consumer Law that cannot lawfully be excluded.

14. Changes to these terms

We may update these terms from time to time. We will publish the updated version and, where the changes are significant, notify you by email.

Continuing to use the platform after the changes take effect means you accept them. If you do not accept them, you should cancel your subscription.

15. Privacy

Our handling of your information is set out in our Privacy Policy.

16. General

These terms are governed by the laws of Tasmania, Australia. You submit to the jurisdiction of the courts of Tasmania.

If any part of these terms is found to be unenforceable, the rest continues to apply.

These terms, together with our Privacy Policy, are the entire agreement between us.
